Terms of Service

These Terms of Service (“Terms”) are an agreement between you and ZeroTalentSongs(“we,” “us,” “our”), the operator of zerotalentsongs.com. By using the site or ordering a song, you agree to these Terms. If you don't agree, please don't use the site.

What we do

ZeroTalentSongs creates personalized songs as gifts. You fill out a short questionnaire, we use AI tools to write lyrics and generate music based on your answers, and we deliver the finished song by email — typically within 3 to 5 days.

You must be 18

You must be at least 18 years old to place an order. By ordering, you confirm that you are.

How an order works

1. You complete the questionnaire and pay through our checkout (powered by Tranzila).
2. We use your answers to generate lyrics and music with AI tools (Anthropic Claude for lyrics, Suno for audio).
3. We email you a link to download your song, usually within 3 to 5 business days.
4. You can purchase optional add-ons such as an extra verse, an edit, or priority delivery.

We do our best to meet the delivery window, but on rare occasions delivery may take longer due to AI provider outages, unusual order volume, or content that needs to be regenerated. If we expect a meaningful delay, we'll let you know.

AI-generated content disclaimer

Your song is created with the help of generative AI. The lyrics are written by an AI model based on your questionnaire answers, and the music is generated by an AI music model. The result is unique to your order, but no human composer or vocalist created it from scratch.

AI output is unpredictable. Pronunciations, names, melodies, and phrasing may not match what you imagined. We curate, prompt, and review, but we cannot promise a specific creative outcome. If you're not happy with your song, see our Refund Policy — we offer a 30-day satisfaction guarantee subject to the conditions described there.

You acknowledge that, under current US Copyright Office guidance and similar authorities elsewhere, purely AI-generated material may not be eligible for copyright protection. This means that, in some cases, neither you nor we may be able to enforce copyright in the song against a third party who copies, re-records, or re-generates a similar song. You agree that this is a known characteristic of AI-generated work and is not a basis for a refund, including in situations where:

• Someone else uses a similar prompt and gets a similar-sounding song.
• A third party copies your song, with or without attribution.
• You are unable to register the song with a performing-rights organization or copyright office.

We do not pursue copyright claims on your behalf, and we have no obligation to do so. If you need legally protectable music for a specific use, please speak with a music lawyer before purchasing.

Ownership and license

When you receive your song, we grant you a personal, worldwide, royalty-free, non-exclusive license to:

• Play it for yourself, family, and friends.
• Share it privately or post it on personal social media accounts as a gift, with credit if you'd like.
• Burn it to a CD, put it on a USB stick, or include it in a personal slideshow.

You may not, without our written permission:

• Use the song for commercial purposes (in advertisements, monetized YouTube content, paid streaming releases, films, podcasts you sell, etc.).
• Resell or sublicense the song.
• Claim that you wrote or composed the song.
• Use it in a way that is illegal, hateful, or harassing toward another person.

If you want a commercial license, email us at zerotalentsongs@gmail.com — we may grant one for an additional fee.

We retain the right to use anonymized, de-identified versions of generations (without your or the recipient's name or identifying details) to improve our service, debug issues, and train internal quality reviewers. We will not publicly publish your specific song without your permission.

Because AI-generated output may not be eligible for copyright protection in some countries (including the US), we cannot promise that any copyright in the song is enforceable against third parties.

What you promise us

When you place an order, you promise that:

• The information you give us is accurate.
• You have a reasonable basis to share information about the person receiving the song.
• You will not submit content that is illegal, defamatory, hateful, sexually explicit involving minors, or that infringes someone else's rights.
• You will not try to use the questionnaire to generate content about real public figures in a way that is misleading, defamatory, or otherwise harmful.

We reserve the right to refuse or cancel any order that violates these promises and to refund the payment.

Payment

All prices are in US dollars unless stated otherwise. Payment is due at checkout. We use Tranzila to process payments and do not store your card details.

Prices, discounts, and promotions are subject to change without notice. The price charged for an order is the price in effect at the time the order is placed, and is shown on your order-confirmation email. From time to time we may run promotions governed by their own terms; if a promotion's terms conflict with these Terms, the promotion terms govern that promotion only.

By submitting payment information at checkout, you represent that: (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; (iii) the charges incurred will be honored by your card issuer or payment provider; and (iv) you will pay the charges incurred at the posted prices, including any applicable taxes.

Refunds

We offer a 30-day satisfaction guarantee, subject to the conditions described in our Refund Policy — including how cash refunds vs. re-generation credits are decided when a song has already been downloaded and used.

Service availability

We try to keep the site running smoothly, but we don't promise uninterrupted access. We may take the site down for maintenance, updates, or reasons beyond our control. We may also change or discontinue features.

Privacy

All personal information we collect through the Services is governed by our Privacy Policy. By using the site or placing an order, you acknowledge that you have read and accepted that Privacy Policy. The Privacy Policy describes what we collect, how we use it, who we share it with, and the rights you have over your data.

We use third-party service providers — including some located outside the country where you reside — to operate and improve the Services. Using ZeroTalentSongs means accepting that your data may be transferred to and processed in those jurisdictions. See the Privacy Policy for the current list and the safeguards we apply.

Third-party services

The site relies on third-party providers (Anthropic, Suno/SunoAPI.org, Vercel, Supabase, Resend, Tranzila, Meta, and others). When you use ZeroTalentSongs, you also accept that data may flow through these services as described in our Privacy Policy.

Limitation of liability

To the fullest extent permitted by law, ZeroTalentSongs is not liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some jurisdictions don't allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless ZeroTalentSongs and our affiliates, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — payable to any third party that arise out of or relate to:

1. Your breach of these Terms or any document they incorporate by reference (including the Privacy Policy and Refund Policy);
2. Your violation of any law or the rights of a third party (including the person the song is about); or
3. Your access to or use of the Services, including any content you submit to us and any use you make of the song we deliver.

We will notify you in writing of any claim we believe is covered by this section. Failure to give prompt notice does not relieve you of your obligations unless that failure has materially prejudiced your ability to defend the claim. We may, at your expense, control the defense and settlement of any covered claim, including selecting counsel, but we will not settle any claim that requires non-monetary obligations from you without your consent (which you will not unreasonably withhold). You agree to cooperate in good faith in the defense of any covered claim, including by providing relevant documents and information at our reasonable request.

Disclaimer of warranties

The service is provided “as is” and “as available.” We don't guarantee that the song will meet every expectation, that delivery will always be on time, or that the site will be error-free.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If you are a consumer in the EU or UK, nothing in these Terms takes away the rights you have under the mandatory consumer protection laws of your home country.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the “Last updated” date at the top. If the changes are significant, we'll let you know by email or with a notice on the site. Continuing to use the site after changes means you accept the new Terms.
